How Does The Probate Process Work?

As you know, the probate process can be incredibly troublesome. There are a lot of heavy emotions when it comes to losing loved ones and what to do with their remaining assets. There are sentimental feelings centered around heirlooms and special family items handed down from generation to generation. Emotions will run high, and there could be a lot of family drama that nobody needs. 

When you experience the death of a loved one, it is a good idea to consult with professionals in the probate process. Probate is the analysis and distribution of estate assets owned by the deceased person. The assets become subject to probate court. The belongings in question need to be reviewed and transferred to the beneficiaries. 

These assets will be divided and distributed to the beneficiaries. The distribution of the assets will occur after a court provides a final ruling. The probate proceeding will begin after analyzing whether or not the deceased person in question has a legal will.

In typical cases, the deceased person has documentation that contains specific instructions on what to do with their assets. These instructions include how the assets are supposed to be distributed after death. In other cases, the deceased doesn't leave a will, and the result will be created in exceptional circumstances.

If the deceased person has a will, the process will work differently. A dead person with a choice in place is known as a testator. So now, someone must come to instigate the probate process when this testator dies. This person's role is to help facilitate the distribution of the deceased person's assets and is known as an executor. The executor is typically a family member, and this is a vital role.

The executor's responsibility is to file the will with the probate court. Different states have their own rules regarding this part of the probate process. However, there are rules to be observed within this timeframe. So now begins the process of involving the court which will determine the authenticity of the will pertaining to the true last testament of the deceased Then, the court will officially appoint the executor named in the will. From here this will give the executor the legal power to act on behalf of the dead.

What Is The Executor's Role During Probate?

The purpose of the will is to designate a legal representative (enter the executor), which the court must approve. This executor is then held responsible for the location of the deceased's assets. It is up to the executor to estimate the sum value of the estate by using the date of death. The executor can also use an alternative valuation date specified by the Internal Revenue Code. 

Take note that most of the assets are subject to the probate administration and will come under the supervision of the probate court where the deceased lived. Matters of real estate are an exception. There are rules for real estate properties depending on the country of the property. The executor's responsibility is to pay off all taxes and debt owed by the deceased from the estate. All creditors have a limited time from the date of death to collect on the estate for the money owed. The timeframe for this is precisely one year from the moment of death.

Ultimately the probate judge will have the final say on whether the claim is justified. Any claims that the executor rejects can be handed over to the court. It is also up to the executor to file personal income tax returns for the deceased. If there are any pending estate taxes, they can come due within one year from the date of death. Finally, the executor has to take a full inventory of the estate and calculate the value of the assets. The executor then has to seek authorization from the court to deliver what is left of the estate to the beneficiaries.

So what happens to the deceased person's estate debts outweigh the assets? The executor will most likely choose not to initiate the probate process. Instead, the executor will have to check with each state to get clarification on the statute of limitations ruling.
